1. Introduction
Welcome to Glitch Servers. By using our services, you agree to comply with and be bound by the following Terms of Service and Acceptable Use Policy. If you do not agree with these terms, please do not use our services.
2. Compliance with Laws
Customers must use our services in accordance with all applicable local, national, and international laws and regulations.
3. Account Registration and Use
Customers are responsible for providing accurate and current information during registration and maintaining the confidentiality of their account credentials. Customers are liable for all activities conducted through their account.
4. Acceptable Use - Prohibited Activities
The following uses of Glitch Servers' services are strictly prohibited:
- Cryptocurrency and Blockchain Activities: Any resource-intensive blockchain-related operations, including cryptocurrency mining, transaction verification, or running blockchain nodes.
- Proxies and VPNs: Use of proxies and VPNs is permitted for legitimate personal or business purposes (e.g., accessing internal resources). Use for IPTV or similar streaming services is not allowed.
- Media Streaming: Media streaming of any kind is prohibited to prevent excessive bandwidth usage and resource strain.
- Illegal Activities: Any use that promotes or engages in illegal acts, including but not limited to hacking, fraud, trafficking, or copyright infringement.
- Malware and Exploits: Hosting or distributing malware, phishing content, exploits, or tools intended to compromise systems.
5. Fair Usage Policy
To ensure fair and stable service delivery for all customers, Glitch Servers enforces the following Fair Usage rules:
- Each customer is subject to a 2TB monthly bandwidth allowance under our fair usage policy. Once this threshold is exceeded, data transfer speeds may be throttled to maintain network integrity for all customers.
- Customers must use CPU and RAM resources in a fair and reasonable manner.
- Running a virtual server at or near 100% of its allocated CPU capacity on a continuous or sustained basis is considered abusive usage, as it negatively affects performance for other customers on the same host node.
If a customer consistently consumes excessive CPU or RAM resources, Glitch Servers may take one or more of the following actions:
- Request that the customer reduce their workload
- Recommend or require an upgrade to a higher-tier VPS plan or a dedicated server
- Apply temporary resource limits or throttling
- Suspend or terminate the service in cases of repeated or severe abuse
These measures are in place to ensure fair access to compute resources for all customers on shared infrastructure.
6. Billing and Termination
- Invoices must be paid by the due date specified. A 5% late fee may be applied to overdue invoices after 24 hours of the due date.
- Services unpaid for more than 72 hours after the due date may be suspended. Services unpaid beyond 7 days will be terminated.
- Customer data is retained for up to 12 months after termination in accordance with our Data Security Policy, after which it is permanently deleted.
- It is the customer's responsibility to ensure timely payment and perform any necessary backups prior to service termination.
7. Refunds and Cancellation
By placing an order, you expressly acknowledge and agree to the following:
- No general refunds. Glitch Servers does not offer refunds as standard. Services are billed in advance, and the fee paid covers the service period in full regardless of usage.
- Free trials and evaluation. We provide free trials on selected services so you can evaluate suitability before purchasing. You are strongly encouraged to use these trials to confirm the service meets your needs.
- Waiver of 14-day cooling-off period. Services are provisioned automatically and immediately upon payment. By placing an order, you expressly consent to the immediate performance of the service and acknowledge that this waives your right to the 14-day cooling-off period under the Consumer Contracts Regulations 2013.
- Limited refund eligibility. Refunds are only issued where a service is completely unavailable and unusable due to a fault on our side. Any refund issued will be proportional to the period of confirmed downtime.
- Exclusions from refund eligibility:
- Downtime caused by scheduled maintenance (notified in advance)
- Downtime caused by force majeure events
- Downtime caused by customer action, misconfiguration, or third-party software
- Services used for illegal or malicious activities
- Setup fees, one-time charges, and unused time on active services
- Dedicated servers (treated as non-refundable B2B transactions)
- Chargebacks. Initiating a chargeback without first contacting us to resolve a billing issue will result in immediate suspension and possible termination of all associated services. All chargebacks are treated as fraudulent unless first resolved by mutual agreement.
Full details are set out in our Refund Policy, which forms part of these Terms of Service.
8. Data Responsibility
Glitch Servers provides limited backup options (e.g., two slots per customer) as a convenience only. Customers remain fully responsible for maintaining their own backups. Glitch Servers is not liable for data loss under any circumstances.
9. Changes to Terms
Glitch Servers reserves the right to update these terms at any time. Significant changes will be communicated in advance. Continued use of services after updates constitutes acceptance of the new terms.
10. General Compliance and Spirit of Use
These terms are intended to provide general guidance. Customers are expected to act in the spirit of fair and reasonable use, even in situations not explicitly covered. Glitch Servers reserves the right to determine, at its discretion, whether a customer's use violates these principles.
